The Americans with Disabilities Act states that ADD/ADHD is a disability. Therefore our kids are entitled to a free, appropriate public education based on their individual needs. Parents who feel that their ADHD kids are in jeopardy of being kicked out of school or punished because of their disability should insist that the schools conduct an evaluation to determine what educational needs their child has. The findings from the evaluations are called IEP's (Individualized Education Program) and the parent's are involved in this process. It is a written, legal document that describes the special education and related services to be provided to the student and ensures educational opportunity for students with disabilities. I had to learn the hard way on all this but it has really been beneficial in protecting my 7 year old son. Some parent's are reluctant to have their kids officially labeled 'disabled or special needs' at school but my son was already being labeled as a bad apple anyway due to all the trouble he was causing. At least now he is receiving the special services that he needs from the school system.

Just wanted to share my experience in case it could benefit someone else.
