does anyone live in florida that can answer this question for me? i will be getting married again sone and i was told that my sons mother will take me back to court for more money because now we have joint income.

I have no idea if your sons mother can come back for more money due to your new wifes income ???? I wish I had more advice for you .......... maybe you could call an attorney and request a free consultation ??

Yes, your x can take you back and get more money. It can also work against her - if she is making more money than previously recorded and such. I am going through this right now - it is a new FEDERAL law within the Department of Revenue. It is not decided on state level. Dont forget, child support is ment to take care of our children and make sure they live in a lifestyle they might have had if the couple were still together.

Hi Bill!! To my understanding she can not take to court for more money because it is not your income. It is your soon to be wife's income therefore she could only take you for your income. However try to put everythings into your future wife's name that way she has no proof.. Or maybe under a realtive you trust..

When you get married your ex can't get more child support because of her income. Regardless that you are married the law does not see that it is her responsiblity to pay for your child. They will not make you pay more based off of her income. If you are making more money then yes it can raise. Just like if you have other kids or have kids with the soon to be wife that also takes play in the child support. So to answer your question no she can't get more money based off of joint income, its not your income its your wifes. If that makes sense. (Started Law School)

My fiance and me are getting married in June.We have 2 sons a 7 year old and 14 year old he pays support for his 2 other sons,will the courts recognize him as the custodial parents 2 our 2 sons and lower his support order so he can provide 4 our boys too.

Congrats Bill I learned that your ex has to have another reason other than you getting married to be able to take you to court to get married it called "a deviance" I have the same question just checking out blogs to see if anyone else has heard the same thing.

My husband and I have been married for almost a year. This is the first year we will be filing as joint income. My husband already pays child support, but has recently lost his job. I know he can do a modification of child support but will they go by my income because he has not found a job yet?

I live in oklahoma. The step parants income has no bareing on the CS because she is not responsable for the child. It will be yours and her income alone. If you get a raise she can take you back.

I am getting married in December. I have a 2 year old boy and my fiance has 14 year old twins. My ex pays only $110 per month and I made this awesome offer to him if he promised not to be a jerk to me for the rest of our lives... sounds silly, but it worked! However, my fiance pays $400 per month now out of his unemployment. He enters the sheriff's academy in June and will recieve a higher wage. We already know she will probably file a motion to increase the support. We figure it will be close to $1000 per month. Again, no problem with that. The issue is, he owes $25,000 for 18 months he was without a job / income due to heart attack and other medical issues. The judge won't budge on this so "we" owe this still. He wants to pay it off before we get married because he is afraid they will come after me for the money. Can they do that? I own a restaurant by myself and honestly times are very slow... I'm not making any money myself. Can they touch my business in anyway?

i am in the same boat bill. i got married in march of 2009, it was bad for the first few months and we were going to get an anolment or how ever you spell it. we split up for a bit and dated other peeps while we still were married, and i happen to be the one to get another lady prego. since that time me and my wife are happy we worked out the kinks in the marriage and enjoy every minute of it. my question is, if i got this other lady prego and me and my wife are together. do they attack mine and her incomes for child support or just mine, because she has nothing to do with what happend.

HELP PLEASE!!!!! WE DONT KNOW WHAT TO DO.
My fiance is not a citizen but has a daughter who is. He is not on the birth certificate either. Him and his ex agreed to let him see her on the weekends. he had also been gving her at least 300 every pay persiod for what ever the baby needed But now she will not let him see her at all... There is no legal papers or documents saying that he cant see her and they have never been to court, she is just being mean to him. She said she doesnt want help from him anymore and refuses to let him see his daugher. Whats should he do so that he can see her and how can he go about putting him self on child support and visitations. or can he? since he is not legal.

My husband and I married about 6 month ago... His ex find out and now she wants to take him to court and get more money from him considering my income also... Can she do that?... My husbands ex had decided she wants more child support since him and I have gotten married. She has found out that I make more then my husband. She wants more support even after we have paid her support for 5yrs when two of the three kids lived with us. Is there anyway we can get credit and not have to pay her anymore support at all.

I have two questions I am engaged to a man he pays child support he is not behind but someone told me if he gets layed off that I would be responsible to pay his child support if he can not pay for it all. The other question I have as I was told if we get married the ex can take him back to court and use my wages to get more child support. Is this true? We live in Madison, WI
