I'm 38 weeks pregnant with my first child. I want to stay home with my baby for 8 weeks after he comes, but Im not sure if that will be possible. My boss does not offer any paid materntiy leave and he only wants me to take 4 weeks off. I think it's the law that he has to let me take 6, but I'm not 100% sure on that. I'm really nervous about leaving my baby in a day care type of situation. I found a really great lady would watches infants in her home, but Im still scared. So Im wondering if its safe to leave a baby that young in a daycare type of situations, she has 3-4 other babys that she watches that are older. Someone please give me some advice. Thanks!!

Hi there, sorry to hear of your situation, I have a similar situation. I looked further into company policy and there is such thing called (FMLA)family medical leave act. Check with your HR department. There may also be other types of leave and remember it is considered a disability. Please do some research. Its not up to your boss, its whats legal that counts!

What Alicia says is correct. If your boss has more than 50 employees ina 75 mile radius and if you have worked there for at least 1 year and 1250 hours, you would be covered under the Family and Medical Leave Act (FMLA). Your boss would have no say in your leave if you qualify - you are entitled to take 12 weeks of leave. It may not be paid but your health benefits and your job would be protected. In addition, some states have additional maternity leave options. I had my son 7.5 months ago and, because of FMLA and state regulations, was able to stay out 6 months and came back to my job. Do talk with your HR department and good luck and best wishes!
