| HI. MY HUSBAND AND I WENT THROUGH A ROUGH TIME TRYING TO ADOPT A BABY WHO WAS TO BE BORN INJULY 2003 THE MOTHER CHANGED HER MIND AND I THOUGHT I WAS GOING TO DIE. GOD BLESSED US WITH TWO BEAUTIFUL BABIES AND WE WOULD LIKE TO ADOPT TWO A BOY AND A GIRL. THE BABY WE WERE GOING TO GET THAT THE MOTHER CHANGED HER MIND GOT KILLED LAST HOLLOWEEN NIGHT SHE WAS 2 YEARS OLD. I SAW THE MOTHER ABOUT A MONTH AGO AND SHE TOLD ME IF I HAD GAVE HER TO YOU SHE WOULD STILL BE ALIVE. My husband has a family member that lives in KY. So I went to my adoption laws site because I thought this was an agency placement state only and it is. A baby or child may not be placed directly. If you would like to place your daughter up for adoption you will need to contact DHS Office or an agency. I hope this helps you.
Kentucky
Who may adopt?
Any person may adopt who is at least 18 years of age and is a resident of the state, or has been domiciled in the state for at least 12 months prior to filing a petition, regardless of marital status. Spouses must petition jointly.
Who may place a child for adoption?
A birthparent may place directly only when placing a child with the grandparent, stepparent, aunt, or uncle. All other placements require permission of Cabinet for Families and Children. The Cabinet for Families and Children and duly licensed child-placing agencies facilitate agency placements.
Is birthparent counseling required?
Kentucky has no statutory requirement for counseling, though the judge takes into consideration whether the birthparent has consulted with anyone, including counselors, in deciding to place the child for adoption.
May birthparents receive assistance with expenses?
Financial assistance is available for living expenses, placement services, and legal fees.
How are putative father rights addressed?
Kentucky does not maintain a putative father registry. A putative father's parental rights must be terminated prior to adoption under any of the following circumstances: if the putative father is identified by the birthmother in an affidavit; if the putative father has married the birthmother or lives with the birthmother or the baby; if the putative father's name appears on the birth certificate; if the putative father pays the birthmother's hospital bills; or if the putative father acknowledges paternity within 60 days of birth.
When may the birthparent(s) relinquish custody and consent to adoption?
A birthparent may not consent to adoption any sooner than 72 hours after birth of the child.
How much time does a birthparent have to change his or her mind after consenting to the termination of parental rights?
In general, a birthparent may revoke consent within 20 days after consenting to relinquishment and adoption. Where state placement approval is required, a birthparent may revoke consent within 20 days of providing consent or of obtaining state placement approval, whichever occurs later. ↑ |
