We did an independant adoption with our son Michael. We matched with a birthmom thru a facilitator, took him home from the hospital and are finishing the homestudy thru the state.

so do you have to have a lawyer or can you just do the paperwork by yourself? What about if the child is from a different state than you? Can you bring the child home from the hospital before the paper work is done or do you need everything done before hand.... I have tried searches online and i'm not finding much....

we have a completed homestudy but do we have to have everything done ...what is the birth mother responsible to have done?

What state is the BM in you are inquiring about? It differs from state to state as to the requirements.

There are different laws regarding different states and adoption is one thing you don't want to do incorrectly. At the very least I would talk with a lawyer once you have met someone you want to match. Attorneys aren't as much as you think they might be. We signed on with our attorney for a $1500 retainer.

Yes we have signed and paid a retainer to our attorney too. They will research the laws for whatever state you may have an adoption situation in and laws vary from state to state. Even the best internet information is usually not up to date. I would advise seeking the aid of an adoption attorney to clarify the laws of your state and state of the birthmom. The interstate compact can be tricky!

That they are not legal in all states, You still need an approved homestudy and a really good lawyer experienced in adoption laws. With knowledge of what a potential birthmom needs as far as counseling etc.

Yeah we have an approved homestudy and are watching to adopt a child thru the foster care system or independent adoption.... or both... lol....Thanks for the responses guys we are getting info this week from some adoption lawyers :-)
