I have two questions I am engaged to a man he pays child support he is not behind but someone told me if he gets layed off that I would be responsible to pay his child support if he can not pay for it all. to Joe- Your girlfriend's income will not affect the amount of child support that is requested from you. Her income is completely seperate from yours. Child support only cares about the child's parents income, which is yours and the mother of the child. Even if you were to marry your girlfriend, her income still would not be included. If the amount the court orders for you to pay is high and you can not financially survive, trust me, the only suggestion they have for you is to get a second job. ↑ |
to Kathy- I am not familiar with the laws in WI, but here in California, the parent being paid child support cannot take the other parent to court, due to getting married. Your income should not be a factor. The only income the court takes into account are the incomes of both the father and mother to the child. Now, if he were to ever lose his job, the financial obligation still stands. No matter his employment status, he has a monthly court order obligation that must be paid if not now but later when he gets a job. The amount accumulates with every passing month, but still it is not your income that will be reviewed. When he becomes employed again, he will need to pay current and arrears to be able to be up to date with his payments. ↑ |
to Maria- The father of your child can not say that he will not pay an increase of child support and think it is that simple. The court has ordered a new amount and unless he contests that amount, has other children he needs to support, there is no way around that. He would need to spend more time with the child and take you back to court for a modification. Giving up his parental rights is something you both have to agree upon and yet parental rights is a seperate issue from financial responsibility. Simple making those remarks does not mean he can acquire what he'd desire. ↑ |

I was under the impression that that would make her new husband the legal father and that would cancel out my child support obligations. i pay csa to my partner who i have a different address from for benefit reasons and csa reasons! however we are planning to get married next year will i still be able to pay her csa if i keep my own flat?? this also means i can pay my other child only half the money due to me not being registered at my partners soon to be wifes address ↑ |
